On March 23, 2021, Emily Phelps, Pierpont’s neighbor, saw Lowe walk “diagonal wise from the church yard” toward her apartment building, noticed “he was kind of looking over his shoulders, all paranoid,” and observed that he had a McDonald’s cup. Transcript Volume II at 65. Phelps heard a “boom, boom,” and she and her boyfriend Michael Ladd heard a person yell “I’m going to kill you, b----.” Id. at 65, 78.
