Judge Scheele concurs in result On May 7, 2022, thirty-three-year-old Murphy, a resident of Arkansas, was operating an electric two-wheel foot scooter on a sidewalk near the intersection of Illinois Street and West Henry Street just south of downtown Indianapolis when the scooter “hit a depression in the concrete that was not visible as marked.” Appellant’s Appendix Volume II at 166. This caused Murphy “to be thrown from the scooter fracturing [his] left knee cap which required surgery.” Id.
