The brothers were tried together in a single jury trial. Before opening statements, the court gave the jurors preliminary instructions both in writing and orally. The instruction at issue in this appeal—Preliminary Instruction 5— identified the charges against each brother. Appellant’s App. Vol. II p. 147. As part of the instruction, the jury was given a copy of the charging information that had been filed against each defendant. Id. at 148-51.
