State of Indiana ── Case No.: 23A-PC-02468 Court: Indiana Court of Appeals Date: December 30, 2024 Author: Judge Nancy Vaidik County of Origin: Delaware Category: Criminal Decision: Affirmed Judge Weissmann and Judge Foley concur The underlying facts of this case are as follows: On the night of October 30, 1999, [the Ball State University] chapter of Kappa Alpha Psi Fraternity held a fundraiser at a local YWCA. After the fundraiser, there was a party at the house of a few of the fraternity members (“Kappa house”) [in Muncie]. [Artie Thomas] and seven or eight of his friends[, including Michael Bruno and Jeriel Williams,] went to the Kappa house, but were turned away at the door. They were told that the party was full and it was only for Kappa members.
