In the Timber Point parking lot, law enforcement officers discovered a parked car with its lights on. Officers found Smith sitting in the driver’s seat of the car. Officer David Hutson questioned Smith about the shooting. While questioning Smith, Officer Hutson observed what appeared to be a handgun next to the driver’s seat, and he asked Smith if there was a gun in the car. Smith replied affirmatively.
