Two of Hathaway’s children, ages 6 and 11, were in the vehicle at the time of the stop. Officers located the marijuana and approximately one gram of cocaine in the vehicle. The State charged Hathaway in Cause 91D012404-F6-000079 with possession of cocaine as a Level 6 felony1 and possession 1 Ind. Code § 35-48-4-6(a). of marijuana as a Class B misdemeanor2 (the “Felony Cause”).
