The facts most favorable to the judgment reveal that in December 2022, after
forty-six years of marriage, Tessa McGann (“Tessa”) filed a petition to dissolve
her marriage to sixty-nine-year-old McGann. McGann expressed his
unhappiness about the dissolution of his marriage by texting Tessa and

IND. CODE § 35-45-10-5. The jury also convicted McGann of Class A misdemeanor invasion of privacy;
however, McGann does not appeal that conviction.
