On September 8, 2018, Hutchison and Burns hired RKW to build a house for
them in Franklin, Indiana. In the contract, RKW estimated the house would
cost $573,295.17 to build, plus a nine percent contractor fee of $51,596.57, for a
total cost of $624,891.74. The contract also included a provision regarding
attorney fees:
6.8 ATTORNEY’S FEES
In addition to damages, the prevailing party shall recover
reasonable attorneys fees and legal expenses if arbitration or
litigation occurs between the parties to this Agreement.
