Decision: Affirmed
Judge Vaidik and Judge Kenworthy concur
On October 19, 2020, twenty-two-year-old Comiskey lived in a house in Gary
with five other adults and eleven children. Two of the children were sevenyear-old A.B. and her twelve-year-old brother B.B., who that day were in the
basement of the house watching a movie. Comiskey came to the basement and
began playing with A.B. by tossing her onto a bed and tickling her. As they
wrestled, the blanket that had been covering them fell off, and B.B. saw that
Comiskey’s hand was down A.B.’s pants. B.B. hit Comiskey on the head with
a metal water bottle.
