After spending time in the bar, Cunningham encountered Samuel Mayberry and Matthew Perkins in the bar’s parking lot. Neither Mayberry nor Perkins knew Cunningham. After Mayberry got into Perkins’s car, Cunningham followed Perkins as Perkins drove Mayberry back to Mayberry’s house. Cunningham parked behind Perkins’s car when Perkins stopped to drop Mayberry off. Cunningham got out of his car “and said I thought you were coming to my house.” (Tr. Vol.
