The police tried to identify him, but Matthews gave them an incorrect date of birth. Smelling alcohol on his breath and finding three open alcoholic beverage containers in his car, the police gave him field sobriety tests, which he failed. The certified breath test indicated he had an alcohol concentration of 0.191 grams of alcohol per 210 liters of breath. [3] The State charged Matthews with four counts related to this incident.
