As Rasp walked out of the restroom a few minutes later, he “encountered [McFadden] bending over on [the] cigarette rack behind the sales counter[,]” taking “some Cigarillo Swisher Sweets” and “a pack of Newports.” Transcript Vol. 2 at 182. The Newports cost $10.08 after tax and the Swishers cost approximately $1.30. See id.
