When they arrived, McNary’s husband told them that she had hit him and showed them an injury on the top of his head. The officers determined they had probable cause to arrest McNary for domestic battery. When they informed McNary that she was under arrest, she said “I’m not going to jail.” State’s Exhibit 1A at 3:38. 1 She then walked from the living room, where she had been speaking with officers, into a bedroom.
