Background In June 2018, Everling met with his supervising probation officer who told him that he needed to complete a drug screen and that probation was going to do a home visit. Everling, who appeared nervous and was sweating, responded that a home visit would violate his constitutional rights and that he did not need to use the bathroom. His probation officer told him he had to stay until he did the screen, so he sat with his girlfriend, Tysha Cummings, in the lobby of the probation office.
