On May 9, 2023, Gilbert and his girlfriend, Mary Wagers, were staying in a
hotel on Emerson Avenue in Indianapolis. Around 1:00 p.m., the couple
returned to the hotel after visiting a nearby fast food establishment. At 1:23
p.m., Wagers returned to the hotel room, alone, and sat at a desk. She began
listening to music through her earbuds and exchanging text messages with her
father.
