There was ongoing tension in their relationship. On September 14, Denny was having a “bad day” and was upset because the tire on her motorcycle had blown. Tr. Vol. II p. 114. Swisher and Denny also argued because Denny failed to clean up the yard after her two rottweilers. After the argument, Swisher turned her back to Denny and began walking up the stairs in her home.
