Pierce had asked Spencer to fly the plane to a maintenance facility for a planned inspection. Shortly after takeoff, the airplane “suddenly descended and crashed[.]” Appellant’s App. Vol. 2, p. 49. Spencer survived the crash, but he sustained serious injuries, including “permanent vision loss in both eyes from traumatic optic neuropathy, permanent and traumatic brain injury, and amnesia.” Id. at 50.
