The morning of July 13, Applegate drove a Dodge Nitro along Upper River Road in Clark County. Cox was in the passenger seat at the time. The two got into an apparent argument, and Applegate, who had a handgun with him, shot Cox in the right leg and then exited the vehicle. When Applegate exited the vehicle, Cox moved into the driver’s seat, put the vehicle into reverse, and backed the vehicle into a wooded area. The vehicle became stuck there.
