The Guarantors each simultaneously delivered individual personal guaranties to NextGear in which they guaranteed Brandmax’s payment of its obligations under the note. Brandmax failed to make the payments due under its note, and, in February 2017, NextGear sued Brandmax and the Guarantors in the Hamilton Superior Court.
