After he provided Newell with a cigarette, Martinez turned around and saw that Newell “ha[d] my son and a pistol.” Transcript, Volume 2 at 54. Newell told Martinez to go in the house and said “he was gonna kill me and my son” if Martinez did not comply. Id.
