When he arrived, the officer observed that Peglow had been placed in handcuffs. Peglow was agitated and would not stop yelling. Officer Shimp removed Peglow from the store and sat him outside on the curb between two parked police vehicles. Peglow screamed racial slurs and vulgarities at the officers and bystanders. Peglow’s behavior seemed manic but also serious and angry.
