Judge May concurs in result In the late evening hours of May 22, 2023, Roberto Hernandez-Concepsion texted Polk and asked Polk to bring $50 worth of cocaine to Roberto at Roberto’s Indianapolis residence. The two texted back and forth for some time; Roberto repeatedly asked where Polk was while Polk repeatedly said he was on his way. A little more than an hour after Roberto’s first text, Roberto texted Polk again and said, “we want it now.” Ex. Vol. p. 51.
