Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. SHORT TITLE. This Act may be cited as the ``H-1B Visa Fraud Crackdown Act''. SEC. 2. INCREASED PENALTIES FOR SERIOUS H-1B VIOLATIONS. Section 212(n)(2)(C) of the Immigration and Nationality Act (8 U.S.C. 1182(n)(2)(C)) is amended-- (1) in clause (ii)-- (A) in subclause (I), by striking ``$5,000'' and inserting ``$100,000''; and (B) in subclause (II), by striking ``at least 2 years'' and inserting ``at least 5 years''; and (2) in clause (iii)-- (A) in subclause (I), by striking ``$35,000'' and inserting ``$250,000''; and (B) in subclause (II), by striking ``at least 3 years'' and inserting ``at least 10 years''. SEC. 3. PENALTIES FOR DOCUMENT FRAUD. Section 274C(d)(3) of the Immigration and Nationality Act (8 U.S.C. 1324c(d)(3)) is amended-- (1) in subparagraph (A), by striking ``not less than $250 and not more than $2,000'' and inserting ``not less than $1,000 and not more than $10,000''; and (2) in subparagraph (B), by striking ``not less than $2,000 and not more than $5,000'' and inserting ``not less than $20,000 and not more than $50,000''. <all>
