07/29/25 Commissioners Special Meeting [5:00-9:45]

Well, if it's not, it's a really good thing, it's not a good thing, it's not a good thing. Right. Well, the key, I think the state statute talks about non-aggressive dogs. It's not a bad thing. You know, that is not the... Like, your dogs then can go to the neighborhood yard? Well, the neighborhood complies with them that it's loud on the issue, it's too often. When you're in the hospital, that's the same thing that we used to live in. Right. If they were to use the neighborhood yard, even if they're not aggressive. I have to address it if they're trespassing, and the order doesn't go into the trespassing, that's on me, uh, use something about it. So who does as an owner, not as a judge? Right. Yeah, those are on me as you know. So where does the wrestling start? They cross over into the neighborhood yard, and come to halfway across and start barking? I mean, I think I can't hear you well. Where does the aggression actually start? The aggression is like fighting people stuff. But that's the difference. Which is not a wrestling to just run up to a guy towards you and why they're jailed. There's no barking move. Well, if the dog, uh, you know, it's down on every corner of the street. You know, when we see it, uh, I've got two big, one fluffy dogs that are always wagging their tails. I would be not impressed to believe that those dogs are ever aggressive. I've got a chihuahua that's aggressive every day that lives in the house. So, you know, I'm sure you've seen dogs how they got the legal terms, pop not the legal terms, but scientific terms, pile away, right? The hair goes up on the back, you know, so, you know, now there's also, you gotta remember there's the state statute that there's also property rights. The landowner, the owns that and if he doesn't want those dogs there, then that's what the landowner, you know, that's a private cause of action. And I should, as a private owner of the dog, to remove those dogs and not have them go along with my neighbor's property. That's what they want. So neighbors don't care that some women. But I think that's the reason we're having this discussion as the neighbors think here. Yeah, and we have a regular set of dogs that continue to do this very thing. The question is, what do we do with them? So as far as the ordinance is going to finally keep country in state life, there is, like some of these ordinances, we're in state law basically, we're in work within it and it's a different entity or what, those words but you can't have that in the right. You can't have a ordinance. Right, otherwise, like, since feeding tickets, you guys have made all county roads feeding tickets, ordinance violations, the collectile homes in Canada, but you can't do that. So I think some of the business cries out here in state law on how to do it, like so these things. That's why, Chad, for the last couple of years has been enforcing the state laws. I think that's basically not very much an inch in all of the ordinances because they're even if they are aware of the state's action, it has some penalties and things like that that you can't do because there's a state law ordinance. And just to be clear, I'm not pretty judging anything, but, you know, it's a priority of these things. What we get into is I feel like we get caught in the middle between what I believe is just for the victim, whether it's a victim of trespass or victim of aggressive dogs biting or the destruction of domesticated animals by strange dogs or whatever. And we can't give Chad or the sheriff a directive because we believe that our ordinance is not correct. So there's already state statute that deals with violent dogs. Yeah. I prosecuted, of course, my career, many of those I prosecuted whenever I was a prosecutor, dogs causing death.
