At approximately 10:00 p.m., most of the guests had left the party, but Bresnahan and three others were outside. J.M. was trying to go to sleep, but Bresnahan and the guests outside were being too loud. J.M. told them that it was “time for them to go” and that they should “either call an Uber or [J.M. would] call the police.” Tr. Vol. II p. 88. Bresnahan responded, “if anyone’s going to leave, it’s going to be you.” Id.
