The facts most favorable to the judgment follow: on January 15, 2016, the State
charged Davis with burglary, a Level 4 felony; residential entry, a Level 6
felony; and theft, a Class A misdemeanor. On August 22, 2016, Davis pleaded
guilty to burglary, a Level 4 felony. 1 As prescribed by the approved plea
agreement, the trial court sentenced Davis to nine years in the Department of
Correction (“DOC”), with five years executed, and four years suspended to
probation.
