State of Indiana ── Case No.: 21A-PC-01198 Court: Indiana Court of Appeals Date: March 04, 2022 Author: Judge Elizabeth Tavitas County of Origin: Madison Category: Criminal Decision: Affirmed Judge Bradford and Judge Crone concur On February 24, 2011, the State charged Moto with sexual misconduct with a minor, a Class B felony, and sexual misconduct with a minor, a Class C felony, under Cause Number 48D01-1102-FB-275 (“FB-275”). Moto entered into a plea agreement, which provided that Moto would plead guilty as charged and that the trial court would determine Moto’s sentence “with a cap of six (6) years on executed time.” Appellant’s App. Vol. II p. 177.
