State of Indiana ── Case No.: 21A-CR-01529 Court: Indiana Court of Appeals Date: March 17, 2022 Author: Judge Elizabeth Tavitas County of Origin: Marion Category: Criminal Decision: Affirmed in Part, Remanded in Part Judge Bradford and Judge Crone concur On May 19, 2017, the State charged Partee with five counts as follows: (1) dealing in cocaine, a Level 2 felony; (2) possession of cocaine, a Level 4 felony; (3) unlawful possession of a firearm by a serious violent felon (“SVF”), a Level 4 felony; (4) possession of a controlled substance, a Level 6 felony; and (5) possession of marijuana, a Class B misdemeanor. On September 25, 2017, the State amended Count 1 to change the basis on which it was enhanced to a Level 2 felony.
