On December 14, 2018, Indiana State Trooper Wyatt Phillips was conducting a
traffic stop at a gas station when Awbrey drove past and waved at him in the
parking lot. Trooper Phillips ran Awbrey’s license plate number and discovered
that Awbrey’s driver’s license had been suspended. Trooper Phillips then
initiated a traffic stop. When Trooper Philips approached Awbrey’s vehicle,
Awbrey asked that Trooper Phillips “not take [Awbrey] to jail.” Tr. Vol. II p.
