State of Indiana ── Case No.: 22A-CR-00041 Court: Indiana Court of Appeals Date: August 29, 2022 Author: Judge Elizabeth Tavitas County of Origin: Elkhart Category: Criminal Decision: Dismissed Judge Riley and Judge May concur Santana’s eleven-year-old victim reported to her mother that Santana had been molesting her for five years. As a result, the State charged Santana with multiple counts of child molesting on January 22, 2018. Santana entered into a plea agreement wherein he pleaded guilty to two counts of child molesting as Class A felonies on September 6, 2018. One of the terms of that plea agreement, initialed and signed by Santana, is as follows: The Defendant understands that he may have the right to appeal his sentence under Indiana Appellate Rule 7B.
