Wanda Halbert sues Shelby County Election Commission over clerk race - Action News 5

(WMC) - Wanda Halbert has filed a new civil lawsuit against the Shelby County Election Commission, marking the latest legal fight involving elections in Shelby County. Court records show in the lawsuit, Halbert is not just challenging the Shelby County Criminal Court Clerk election results. In an interview, she told Action News 5 she wants to see the “real numbers.” She is asking the court to preserve evidence, force the election commission to turn over election records, double-check the vote totals, and provide other relief related to how the election was handled. “I just know on election night, seeing those low numbers, the percentages that the candidates were either winning or losing, it was something I’ve never seen since we’ve been here. Not that anything’s wrong with it, but we do want to see the records,” she said. Halbert lost by 126 votes in the Democratic primary for Shelby County Criminal Court clerk. The petition claims over 1,700 absentee ballots were not counted or reflected in the results. Shelby County Election Commission data shows all ballots were reported and the election was certified on May 21. Halbert filed her petition on May 26. Action News 5 reached out to the election commission about these claims. Linda Philips, administrator of elections for Shelby County, said, “Our office ensures that all votes cast are successfully counted for every Shelby County election. Any challenge to the contrary or related litigation would be handled by our attorneys, so we would be unable to comment further.” Halbert says she doesn’t have full access to the results, leading her to question the outcome of her race and others. “They gave me some documents, but it’s not the documentation that we need. It’s, you know, we’re just wanting to see the bottom line numbers, that’s all.” Halbert said this petition does not mean she believes someone cheated or something illegal is going on at the election commission; she just wants to make sure everyone’s votes are counted. No hearings, motions, or trial dates have been scheduled yet.
