On December 8, 2021, the State amended its information and added Count II, operating a vehicle with a schedule I or II controlled substance or its metabolite in the blood, a Level 6 felony. On January 4, 2022, Garrett and the State executed a plea agreement wherein Garrett agreed to plead guilty to Count II.
