Judge Scheele dissents Eliezer Areche was riding an electric foot scooter on a sidewalk in Indianapolis when he hit a hole, fell, and was injured. Areche filed a negligence action against several defendants, including the City of Indianapolis (“the City”). The City moved for summary judgment and argued that Areche could not recover because he was negligent per se for violating a city ordinance that prohibited electric foot scooters from being operated on sidewalks and was, therefore, contributorily negligent.
