Dau claimed that he had “drank beer with [a] friend” after being “kicked out from work” due to inoperable machinery. Tr. Vol. II p. 35. Testing revealed that at the time of the accident, Dau’s blood alcohol concentration (“BAC”) had been “.197.” Tr. Vol. II p. 36.
