Tr. Vol. II p. 9. Burton died as a result of the collision. Prior to operating his vehicle, Toddy had consumed marijuana, fentanyl, and methamphetamine. On September 18, 2022, the State charged Toddy with Level 4 felony causing death while operating a vehicle with a schedule I or II controlled substance in the blood and Class C misdemeanor operating a vehicle with a schedule I or II controlled substance or its metabolite in the blood.
