Indiana Supreme Court rules local judge ‘erred’ in not allowing for jury trial in former FWFD captain, VeoRide lawsuit - WPTA | 21Alive | Fort Wayne, IN

The state’s highest court ruled that Allen Superior Court Judge Jennifer DeGroote erred by entering a summary judgment, a resolution decided by a judge after hearing statements and evidence without going to trial, in the case. The judgment was filed after former FWFD Captain Richard Dolsen was seriously injured while responding to a fire at a VeoRide storage facility. “A jury must sort through these conflicting claims to decide whether VeoRide breached any duty,” the Indiana Supreme Court opinion reads. “For this reason alone, the trial court erred in entering summary judgment for VeoRide.”
