We affirm. Facts & Procedural History The facts, as reported in Hart’s direct appeal, Hart v. State, No. 82A01-0506-CR236 (Ind. Ct. App. April 17, 2006), are as follows: On January 26, 2005, at approximately 4:00 p.m., Evansville police officers responded to a call at an apartment building at 1109 Covert Street reporting that Troy Duerson was causing a disturbance.
