Officer Shoots Partner (Who Was Also Former Lover) in the Back During Apartment [10:06-12:48]

it is a negligent discharge. There are of course exceptions, but they are extremely rare. In my opinion, this case is not one of those exceptions. It wasn't Carlos Baker's fault that he tripped. The mistake he made was moving with his finger still on the trigger. It was reasonable that his finger was on the trigger initially, but when he changed his mind and decided to retreat, he needed to get that finger off the trigger. He knew the pistol could point in an unsafe direction during his retreat. Even though I believe he was negligent in a sense that his firearm handling fell below ideal standards, I do not believe he was criminally negligent. No crime was committed here. He made an unwise decision under an immediate threat. Moving to the second question, did Carlos intentionally withhold aid to his partner, crystal? I think what happened here was that Carlos was trying to get into a position of safety so that Adrian would not be able to shoot him. This is why he ascended the staircase. He was not immediately aware that Crystal was injured. It took Carlos one minute and 44 seconds to get back to crystal, but that was not a long time under the circumstances. Again, Jaywin and Adrian were still in the apartment. They still represented a threat. When Carlos descended the staircase and ran to crystal, he exposed himself to potential fire from the apartment. As far as the romantic relationship, the attorney for Carlos said it was short, casual and ended years ago. Carlos and Crystal were best friends at the time of the shooting. Even if this isn't true, I think Carlos would have been motivated to help Crystal not to harm her. If he had saved her life, he would have been a hero to her and to others. This would only increase the probability of reestablishing their romance. I think the lawsuit here is a bit of a stretch. Now moving to my final thoughts. Cases like this serve as a reminder that police work is dangerous and unforgiving. In precise decisions that may seem minor in isolation can combine and result in catastrophic consequences. Like many tragic police shootings, the situation began with people who allegedly decided not to follow the law. Jaywin and Adrian, if they are guilty, set the stage for this disaster. Crystal Rivera did not lose her life because of a deliberate act, rather because of a moment where everything that could go wrong did go wrong. Those are my thoughts on the case of Crystal Rivera. Thank you so much for watching. I'll talk to you soon.
