Hicks completed the purchase without a survey and received a standard owner’s title policy at closing. A portion of that policy provided that “any encroachment, encumbrance, . . . or adverse circumstance affecting the title that would be disclosed by an accurate and complete . . . survey of the land” is not covered by the title policy.
