Barbour was convicted, following a jury trial, of two counts of Level 6 felony intimidation. During deliberations, the jury sent out a note asking to view two pieces of photographic evidence. In response, and by agreement of the parties, the court ordered that all the admitted evidence, seven exhibits, be shown to the jurors in open court. The State further requested that, because the perpetrator’s identity was at issue, Barbour remove his face mask that he had worn, by choice, for almost all of trial.
