(JPMorgan), the Indianapolis Museum of Art d/b/a
Newfields, Inc. (Newfields), and Oldfields, LLC (Oldfields) (collectively,
Defendants). We affirm based on Ind. Trial Rule 12(B)(8), as the same action
was pending in another court when Appellants filed this action, and thus we do
not reach the issue of whether dismissal was also proper under T.R. 12(B)(1).
We affirm.

JPMorgan is the trustee of a revokable trust (the Trust) created by Alicia C.
Ballard in 1969 and amended in 1981 before her death in 1982.
