State of Indiana ── Case No.: 22A-PC-00443 Court: Indiana Court of Appeals Date: April 21, 2023 Author: Judge Dana Kenworthy County of Origin: Dearborn Category: Criminal Decision: Affirmed Judge Bradford and Judge Pyle concur McMullin pleaded guilty to child molesting and was sentenced in January 2019 pursuant to the terms of a plea agreement. In May, McMullin filed a pro se petition for post-conviction relief, alleging (1) his due process rights and rights under the American with Disabilities Act (“ADA”) were violated in the underlying proceedings, (2) the trial court erred in refusing to grant a change of venue, (3) he signed the plea agreement under duress, and (4) the trial court erred by refusing to allow him to withdraw his guilty plea.
