Decision: Thus, we affirm
In this appeal from the final judgments of conviction for unlawful possession of a firearm and two counts of second-degree assault, appellant raises two issues. First, he argues that the district court plainly erred by allowing the state, shortly before trial, to amend its complaint to add a charge of unlawful firearm possession. Appellant contends that his conviction on that count must be vacated and, for related reasons, he must be resentenced on the second-degree assault convictions. Second, appellant argues that he received ineffective assistance of counsel before and during his stipulated-evidence trial. Because the district court did not plainly err by allowing the state to amend the complaint, we uphold the firearm-possession conviction. But because record is insufficient for this court to determine appellant's ineffective-assistance claim, we decline to address the second issue, which appellant may pursue in a petition for postconviction relief should he elect to file one. Thus, we affirm.
