Indianapolis Construction Services, Inc. (“ICS”) appeals the trial court’s order
granting P&J Portables, LLC’s (“P&J”) motion for declaratory judgment and
determining that, pursuant to an indemnification clause in its Equipment
Rental Agreement (“the Agreement”) with P&J, ICS was obligated to
indemnify P&J for losses that allegedly stemmed from P&J’s own negligence.
We reverse and remand for further proceedings.

ICS was contracted to renovate a Pilot gas station in Lebanon, Indiana (“the
Gas Station”).
