The Indiana Public Defender’s Office later appeared on behalf of Hensley. Through counsel, on August 8, 2023, Hensley filed an amended PCR petition that focused on the circumstances surrounding his decision to plead guilty pursuant to a plea agreement (“the Agreement”). Hensley claimed there was a flaw in the charging instrument seeking a habitual offender enhancement and that, had he known, he would not have entered into the Agreement.
