The terms of these instruments required Howard’s lender to provide a 30-day notice of default before accelerating full payment of the note and filing suit to foreclose on the mortgage. They also allowed the note and mortgage to be transferred to a different lender. Howard’s promissory note and mortgage were transferred several times over the next decade. J.P.
