The victim, accompanied by another juvenile, D.B., followed Hardin while trying to discuss Hardin’s attack on them the day before. As Hardin walked away, Hardin said that “he didn’t want to do this, don’t make me do this.” Prior Case Tr. Vol. II, p. 140. When the victim grabbed Hardin on the shoulder to turn him around, Hardin fatally shot him.
