A month after the breakup, McIntosh and Griffin returned home late one night. As McIntosh prepared to take a bath, she heard commotion in another room. She found Day and Griffin engaged in a physical struggle, each holding a gun. McIntosh tried to call 911. But when Day threatened to start shooting unless she hung up, she dropped the phone. Day then said, “I’ve been wanting to do this,” and shot McIntosh in the shoulder. Exhs. Vol. II, p. 167.
