Mark Bailey Category: Juvenile Decision: Affirmed Judge Riley and Judge Pyle concur On May 17, 2017, the Indiana Department of Child Services (“DCS”) filed CHINS petitions in which it alleged that the Children were born testing positive for amphetamine, benzodiazepines, methamphetamine, and opiates, and that J.B. (“Mother”) tested positive for those same drugs. The petitions further alleged that Father was incarcerated and unable to ensure the Children’s safety and well-being. In September of 2016, Father had been charged with various counts of burglary, criminal mischief, and criminal trespass.
