Case No.: 24A-JT-01544
Court: Indiana Court of Appeals
Date: November 26, 2024
Author: Judge L. Mark Bailey
County of Origin: Floyd
Category: Juvenile
Decision: Affirmed
Judge Bradford and Judge Foley concur
In December 2020, the Indiana Department of Child Services (“DCS”) received
a report alleging educational neglect of Children and substance use by Mother.
At that time, Mother had sole legal custody of Children but she and Father
shared physical custody of Children; each week, Children lived with Mother for
three days and then went to Father’s home for three days. DCS initially
petitioned to adjudicate Children as Children in Need of Services (“CHINS”)
but amended it to become an informal adjustment instead.
